Preamble :

ALINE is the seller of the products and services present on the site.

The commercial website www.aline-fashion.fr (hereinafter referred to as "the website") is an e-commerce website accessible via the Internet network, open to any user of this network.

The manager of the company is Mrs. Nivesse Aline.

The Website enables ALINE to offer her products (hereinafter referred to as "the Products") for sale in France and abroad.

The Site is reserved for private individuals and is forbidden to professionals.

These General Terms and Conditions of Sale (hereinafter "GTC") govern the use of the Website and the services (hereinafter "the Services") that may be offered on it, as well as any purchase that may be made on the Website.

Any use of the Website implies the Customer's full and complete adherence to these Terms and Conditions of Sale. Acceptance of the GTC is made by ticking the box "I fully agree to the General Terms and Conditions of Sale" when creating a customer account.

This acceptance is necessarily full and complete, any conditional acceptance is considered as void.

In the event of a modification of these GTC, the applicable GTC are those in force at the date of use of the Services or the order.

These GTC are available in French, English and German. In the event of a difference between the three versions, the French version shall prevail.

Art.n°1 :THE PRODUCTS 

The essential characteristics of the Products are presented on the Website in each of the Product sheets.

The customer is fully informed that the images, photos and colours of the items offered for sale may however not correspond to the actual colours under the effect of the Internet browser of the screen used.

The products on sale on the Site are available within the limit of available stocks.

If one or more items ordered are no longer available, the Customer will be informed by e-mail as soon as possible.

The Customer may then cancel the order of the item or items concerned and be refunded, where appropriate, the sums already paid, by crediting the bank account corresponding to the credit card used for payment within 30 days at the latest.

Art. n°2 :THE PRICES 

The prices of the Products sold on the Website are indicated by item and reference and are given in euros.

The prices of the products are those indicated on the Website regardless of the place of delivery and include all French taxes (including VAT), excluding shipping costs, which are payable by the Customer (see Art. n°8 for more information on shipping costs).

It is specified that the customs duties and possible taxes requested upon delivery in certain countries in which the Products are likely to be delivered are not included in the prices and are at ALINE's expense (see Art. n°9 for more information on customs duties upon return of one or more Products).

Any change in the applicable legal VAT rate will automatically be passed on to the prices of the articles as soon as it comes into force.

The applicable prices are the prices displayed on the Website at the time of the order.

Art. n°3 :REGISTRATION

When placing an order, the Customer is asked to create an account allowing him/her to see his/her pre-entered data and to benefit from promotional offers.

To do so, the Customer must fill in a personal information form with the most total honesty and is under the obligation to update this information as soon as necessary.

The Customer must also choose an e-mail address and a password that will be requested each time he or she wishes to access it.

The Customer's personal information is thus protected by a password so that the Customer, and only the Customer, has access to it.

ALINE recommends that the Customer does not disclose it to anyone.

In addition, the Customer must log out of his profile and close the browser window at the end of each work session. The Customer will thus prevent users from accessing his personal information.

The Customer is solely responsible for the confidentiality of his password. The Customer alone shall bear the consequences of any fraudulent use of his password.

In accordance with the law of 6 January 1978, the Customer has a right of access to personal data concerning them, which they may exercise in writing to Customer Service at alinenivesse@gmail.com, without prejudice to their right to oppose the processing of such data for just cause.

Art. n°4 : ORDERING STEPS TO CLOSE THE SALE

1- The Customer dials the address

2- The Customer adds the items to his basket.

3- The Customer fills in the account creation form.

4- The Customer verifies the elements of his order, identifies and corrects any errors that may have been made when entering the order by issuing an order summary.

5- The Customer verifies and expressly accepts ALINE's General Terms and Conditions of Sale.

6- The Customer validates the order, the total price and the all-inclusive price, by clicking on "Pay my order".

7- The Customer receives an electronic acknowledgement of receipt containing the elements of his order. The order will then be confirmed only after acceptance of the payment by the Client's bank and receipt of the amount of the order by L'Impertinente.

8- The Client receives an electronic confirmation of his order.

9- The Client receives his package at the delivery address he indicated when placing his order. 

Any order will be validated only after acceptance of payment. At the end of the payment, a confirmation of the order is sent by L'Impertinente to the Client, by e-mail to the e-mail address indicated by the Customer.

The Client accepts that the invoice will be considered as proof of the contractual relationship between the parties. The Client will have the possibility to print the invoice transmitted with the order confirmation.

Some Products are available in pre-order, meaning that they are out of stock but that the stock is going to be restocked: in this case, the Customer is invited to pre-order and the restocking time is indicated under the "pre-order" button.

The payment procedure remains the same. Pre-ordered Products are delivered independently of the rest of the order, within the period indicated when the pre-order is placed.

Art. n°5 :PROPERTY RESERVATION OF TITLE

The Products remain the property of ALINE until full payment for each order has been received.

Art.n°6 : PAYMENT TERMS 

Full payment must be made at the time of ordering. At no time can the sums paid be considered as a deposit or advance payment. No cash on delivery will be accepted for any reason whatsoever.

The Customer pays his order by credit card (Visa, Eurocard/Mastercard) via the secure platform implemented by PAYPAL.

The Website www.aline-fashion.fr is subject to a security system in order to protect as efficiently as possible all sensitive data related to the means of payment used on the Website.

In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable.

Any order placed on the Website implies a guarantee on the part of the Customer that he has all the necessary permissions to use the methods of payment available on the Website.

ALINE reserves the right to suspend or cancel any order if she encounters difficulties in collecting payment.

The Customer may choose to register his payment details in order to facilitate future purchases. This information will be kept by l'Impertinente in a secure manner and will not be disclosed under any circumstances.

Art. n°7 Anti-fraud

ALINE reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.

Any resale of products purchased on the Website is strictly forbidden.

In addition, in order to fight against fraud, L'Impertinente has set up a system implementing exclusion lists, which may lead it to :

(I) to claim, in order to secure the transaction, certain supporting documents once payment has been made, in the event of an automatic alert triggered by information relating to the order.

(II) block any order from a Customer account that was previously the cause of fraud.

Art. n°8 :DELIVERY 

For all orders placed on the Website, we undertake to prepare your order within 24 to 96 hours (excluding weekends and public holidays) and within a maximum of 10 working days during busy periods (Christmas, sales, etc.).

At the time of entering his order, the Customer must choose the delivery method offered on the e-shop website:

- Letter followed, Colissimo

Delivery charges are calculated according to the delivery address indicated by the customer and vary according to the geographical area.

Delivery is free from 150€ purchase for France, Germany, the United Kingdom, Belgium, Luxembourg, the Netherlands, Spain and Austria and from 250€ purchase for all other delivery countries.

For residents outside of the European Union, the customs fees related to the shipment of the order to the Customer are the responsibility of ALINE.

Delivery address :

The Customer may request that the items ordered be delivered to his home, office, a relative's home, holiday location, etc. He also has the option of having the items delivered to one of the physical persons of his choice.

In the event of an error in the Customer's contact details, ALINE cannot be held responsible for the impossibility of delivering the item(s) ordered.

In the event of absence during a Colissimo delivery to the address indicated by the Customer, a delivery notice will normally be left by the Post Office: the Customer can then collect his parcel from the Post Office with an identity document within 15 days following the date of deposit of this notice.

After this period, the parcel will be returned to the company. The Customer Service will then contact the Customer for a possible reshipment for which the expenses are the responsibility of the Customer, or without answer from the Customer, to a refund of the order.

In the event that the Customer is absent when a UPS delivery is made to the address provided by the Customer, the Customer may, at the UPS website, enter the tracking number of the shipment in the InfoTracking Number or InfoNotice of :

- Have the shipment delivered to an available neighbour, if a signature is required.

- Arrange for the shipment to be picked up at a UPS Customer Centre

- Reschedule the delivery date of the shipment for a day when you can receive it.

- Have the shipment delivered to a different address

When a parcel leaves ALINE's warehouses to be sent to the address indicated by the Customer when placing the order, the Customer receives an electronic confirmation of shipment from the Website, indicating the tracking number of the parcel.

The Customer can track the progress of the status of his order in his secure personal space "My Account" accessible on the Website or by going, with his parcel tracking number, to the websites made available by La Poste, Colissimo.

Each delivery is deemed to have been made as soon as the product is made available to the Customer by our carriers, as evidenced by the delivery follow-up offered on the above-mentioned Internet sites of our carriers.

If 7 working days after the dispatch of the parcel, the Customer has no news of his order, he must contact the post office nearest to the place of delivery.

If neither the post office nor the delivery tracking system offered on the websites of our carriers mentioned above say that they have a trace of this package, the Customer must then contact the company through the Customer Service department which will then open an inquiry with the competent services.

The final response times of our carriers vary from one to three weeks from the time the file is taken into account by the services of the company ALINE.

The Customer may, at this stage, cancel his order with Customer Service because of the delay and request a refund of his order. The package, if found, will be sent to our customer service department.

When the Client wishes, on the other hand, to continue his order and receive his product despite the delay suffered:

- If the parcel is found, it is sent to the Client: the reception procedure then follows its normal course (deposit of the parcel or delivery notice).

  • If the package is declared lost (the final answer is often formulated within the maximum time limit, three weeks), we will notify the Client and immediately initiate the refund of the package (products and shipping costs).

Are considered in particular as cases of major force discharging L'Impertinente from its obligation to deliver: war, riot, fire, flood, strikes, accidents, impossibility to be supplied.

In any case, the delivery of our products within the deadlines can only take place if the Customer is up to date with his obligations.

It is the Customer's responsibility to check shipments on arrival and to make any reservations and claims that appear justified, or even to refuse the package, if it is likely to have been opened or if it shows obvious signs of deterioration.

The said reservations and complaints must be sent to the Post Office by registered letter with acknowledgement of receipt.

Delivery in the shop:

Art. n°9 : RETURNS

It is recalled that the legal withdrawal period in accordance with the Consumer Code is 14 clear days, without having to justify reasons or pay penalties. This period runs from receipt for Products or acceptance of the offer for Services.

ESHOP :

For any order placed on the Website, the Customer may return the item(s) that does (do) not suit him/her via the Website or in the shop.

He must indicate the reasons for which he wishes to make a return, and specify whether he wishes a credit note (in the case of an exchange) or a refund (in the case of a definitive return).

If the Customer lives in France, Germany, the United Kingdom, Belgium, Luxembourg, Spain, the Netherlands or Austria, he will receive by e-mail, within a maximum period of 2 working days, a confirmation of his return request as well as a return and delivery note (at the Customer's expense) that he will print out.

The return form is to be cut out on the delivery note and to be completed imperatively if he wishes his return to be processed as soon as possible.

If the customer lives in another geographical area, he will receive by e-mail, within a maximum of 2 working days, instructions to send us the Product(s) he wishes to return by himself.

The risks of returns are the responsibility of the Customer. The Customer is therefore strongly encouraged to return the package by any means that provides proof of its dispatch and gives it a certain date (registered mail with acknowledgement of receipt, colissimo suivi, etc.).

The Product must be returned in new condition, in its original packaging and accompanied by the order return form, to the address indicated on the transport order.

Return shipment costs are at the expense of the Customer.

Products returned incomplete, damaged, worn or soiled will not be taken back.

In case of a refund request :

Returned Products will be refunded to the Customer within a maximum period of thirty days from their receipt by ALINE.

Once the Products have been received, checked, and accepted by our services, the refund of the returned Products at the invoiced price will be made by crediting the amount to be refunded to the Customer's bank account debited during the transaction.

In the event of a request for a credit note :

The exchange will be carried out by the issue of a credit note equal to the sum of the amount of the Products and valid for 3 months.

This credit note can be used in one go. Any balance will be lost.

Art. n°10 :LEGAL NOTE

The Products benefit from guarantees of conformity and hidden defects.

Without prejudice to the withdrawal period provided for in Article No. 9, in the event that the items delivered do not comply in kind or quality with the specifications indicated in the delivery note, the Customer must inform Customer Service by writing to alinenivesse@gmail.com.

He will then receive a return voucher by e-mail, which he will print out.

The Product must be returned in unused condition, in its original packaging and accompanied by the return voucher, to the address indicated on the return voucher.

In the absence of a return voucher, ALINE will not be able to exchange the returned Product. The shipping costs related to the return package will be refunded to the Customer, by crediting the amount to be refunded to the Customer's bank account debited during the transaction.

Once the Product has been received, checked, and accepted by our services, L'Impertinente will proceed to send a new Product corresponding to the Customer's order and conforming to the description of the Product.

If the Product is no longer available, ALINE will notify the Customer by e-mail and offer to give him a credit note or a refund in the amount of the returned Product.

The credit note would then be available on the "My discount vouchers" section in the Customer's "My Account" category. The refund of the returned Product at the invoiced price would be made by crediting the amount to be refunded to the Customer's bank account debited at the time of the transaction.

The withdrawal period does not start again after receipt of the new Product.

Art. n°11:ALINE’S RESPONSABILITY

ALINE is not responsible if the Website is inaccessible or has access anomalies or bugs for any reason whatsoever.

ALINE reserves the right to highlight another person on the website in any manner whatsoever, and is not responsible for external websites to which visitors are directed from the website.

Confidentiality of personal data :

The personal data collected on the Site www.aline-fashion.fr are necessary for processing the order.

When an order is placed on the Website by a new Customer, this database is enriched with information concerning the Customer, which will subsequently make it possible to better meet his expectations and facilitate the assistance services provided by Customer Service.

In accordance with the law of January 6, 1978, the Customer has a right of access to personal data concerning them, which they may exercise in writing to Customer Service at alinenivesse@gmail.com, without prejudice to their right to oppose the processing of such data for just cause.

Intellectual property rights:

All the Products, as well as the texts, comments, photos, trademarks, graphics, concept, illustrations and images composing the Website are the exclusive property of the ALINE company and are protected by intellectual property rights in France and throughout the world.

Any total or partial reproduction of these elements or of the Site is strictly prohibited.

Applicable law and jurisdiction :

In case of translation of the Website and the Terms and Conditions of Sale, the French language shall prevail for interpretation.

These GTC are subject to French law. Any questions of dispute that may arise as to their validity, interpretation, and execution are subject to the exclusive jurisdiction of the courts of Paris, unless otherwise provided by mandatory rules of procedure.
